As per BOOKING FORM ABOVE and section above on PAYMENT
For the running costs in the course of the
trip (provisions / food, diesel and other consumables like cleaning the beddings or re-filling used cooking gas, harbor fees, nature park fees), a „kitty“ will be set up, into which all crew members pay in equal parts. According to nautical tradition, the skipper is exempt from this. The estimated amount of the kitty is between 150-300 euros per person per week.
- Resignation
In the event of cancellation by the crew member, the full contribution is due, unless it is covered by travel cancellation insurance. The skipper reserves the right to accept a replacement crew member.
In the event of boat defects that keep the boat from leaving at the start date, a delay of two days is deemed acceptable for repairs to be carried out, beyond that or if the damage halts the boat longer, the contribution will be refunded either partly or in full depending on if sailing is possible. The same applies if the boat cannot arrive at the start port in time or is delayed or cannot arrive at all. No further compensation will be paid in both events.
- Requirements
The crew member declares to take part in the trip at his own risk and responsibility and that there are no pre-existing health conditions and / or informs the skipper of any restrictions, such as medication, in confidence. The crew member declares that he/she can swim in open water for at least 15 minutes.
5. Skipper
The skipper assures that he has the necessary experience, knowledge and qualifications to safely operate the yacht under sail and engine. He instructs the fellow sailors in the operation of the yacht and carries out a thorough safety briefing. The fellow sailors are encouraged to follow the instructions of the skipper with regard to command of the ship and safety as far as possible. The skipper is responsible for safety on board
and navigation according to the standards of good seamanship.
6. Crew member
Each crew member ensures that they are able to enter and leave the trip country/place – [ COUNTRY NAME TO BE TAKEN FROM TRIP LIST IN BOOKING FORM] – and that they have a return flight ticket if required by the respective guest country upon entry and / or the means to buy it and / or to sustain themselves after leaving the boat in the guest country. Each crew member follows the instructions of the skipper and informs him.
Each crew member also takes care of his or her personal safety and wears a life jacket and life belt if necessary and in any case on the instructions of the skipper.
7. Disclaimer of Liability
Each crew member travels at their own risk, since sailing is a high-risk sport and waives any claims for compensation from all legal aspects for personal injury and property damage against the skipper, the other crew members and the owner, provided he is a fellow sailor if the damage is due to negligent behavior. The exclusion of liability does not apply if damage was caused intentionally or by a liability insurance must be borne.
8. Severability Clause
Should parts of this agreement be or become invalid or unenforceable, this shall not affect the effectiveness of the other parts of this agreement. The same applies if it turns out that the agreement contains a loophole. Instead of the ineffective / unenforceable part or to fill the gap, this agreement should be interpreted in such a way that it comes as close as possible to the intended purpose.
9. Ancillary Provisions
Disputes are judged according to German law. Oral side agreements have not been made. Changes and / or additions to this agreement must be made in writing. This also applies in particular to a waiver of the written form requirement. Each crew member confirms that they have received a copy of this contract for their records.
